Terms of Service

1. Acceptance of Terms

By using the Lulai app (the “App”), you accept these Terms. These Terms are our custom end-user terms in addition to or instead of Apple’s Licensed Application End User License Agreement where permitted; nothing here that conflicts with Apple’s mandatory App Store requirements will apply against Apple’s requirements.

2. Eligibility

You must comply with your App Store account terms and be legally able to enter a binding contract. Lulai is intended for parents/caregivers. You are responsible for the security of your device and Apple ID.

3. License

We grant you a limited, revocable, non-exclusive, non-transferable license to use the App on your devices for personal, non-commercial use. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works of the App except as expressly allowed by law.

4. Service Description

Lulai may provide baby-sleep assistance features including:

• White noise, nature sounds, and lullaby playback
• On-device / smart cry detection and automatic soothing sounds
• Mom’s voice recording and importing music from files
• Auto lullaby switching and playback among selected tracks
• Detection sensitivity and advanced detection settings
• Auto-off timer
• Free and Pro (one-time purchase) feature tiers

5. Important Safety and Medical Disclaimer

LULAI IS NOT A MEDICAL DEVICE AND DOES NOT REPLACE RESPONSIBLE PARENTING OR PROFESSIONAL MEDICAL ADVICE.

• The App is a complementary aid and must never be the sole way you monitor a baby.
• Cry detection may miss cries or emergencies and may produce false positives/negatives.
• A responsible adult must always remain within reach of the child.
• Follow safe-sleep guidance; consult a doctor for health concerns and call emergency services in emergencies.

6. Free / Pro and In-App Purchases

There is no subscription. Free provides core features; Pro unlocks via a one-time App Store in-app purchase.

• All payments are processed by Apple via StoreKit / the App Store; we do not receive card details.
• Pricing is shown in the App Store at the time of purchase.
• Refunds are handled solely by Apple under Apple’s refund policies.
• You may restore purchases across devices with the same Apple ID using App Store / in-app Restore.
• Pro content may be unavailable due to device, account, or App Store restrictions; contact Apple Support when appropriate.

7. Privacy

Personal data processing is described in our Privacy Policy (https://lulai.app under /privacy). By using the App you acknowledge that Policy. Permissions such as microphone can be managed in iOS Settings.

8. Acceptable Use

You agree not to:

• Use the App unlawfully or in ways that infringe others’ rights
• Disrupt, overload, or attempt unauthorized access to the Service
• Reverse engineer or extract source code except where legally permitted
• Add audio/content you do not have rights to use
• Present or use the App as medical diagnosis/treatment or as a sole baby monitor

9. Intellectual Property

The App—including software, design, text, graphics, sounds, and brands—is owned by Lulai or its licensors and protected by law. “Lulai” and logos are our trademarks. You represent you have rights to any custom audio you add.

10. Assumption of Risk

You use the App at your own risk. You alone are responsible for your child’s safety and supervision. Detection is probabilistic; device performance and system notifications may delay or fail. The App is not certified as a safety or medical device.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, the App is provided “AS IS” and “AS AVAILABLE,” with warranties disclaimed. Lulai is not liable for direct/indirect damages, detection errors, or losses from technical failures. Our total liability will not exceed the amount you paid for the App (including the Pro one-time fee) in the twelve (12) months before the claim.

12. Indemnification

You agree to indemnify and hold harmless Lulai and its developers from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the App, content you add, or violation of these Terms.

13. Apple-Related Terms

Apple Inc. and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You and Lulai acknowledge that Apple has no obligation to furnish maintenance or support for the App—that is Lulai’s responsibility. If the App fails to conform to any applicable warranty (to the extent one cannot be disclaimed), you may notify Apple; Apple may refund the purchase price and, to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for claims relating to the App including product liability, failure to conform to legal/regulatory requirements, or consumer protection / intellectual property claims.

14. Termination

We may suspend or terminate your license if you violate these Terms. Upon termination you must stop using the App. Removal via the App Store remains subject to Apple account rules.

15. Governing Law

These Terms are interpreted under applicable law, without prejudice to mandatory consumer protections. Disputes may be resolved in competent courts or by arbitration where permitted.

16. Severability

If any provision is unenforceable, the remaining provisions continue; the invalid provision will be limited to the minimum extent necessary.

17. Entire Agreement

These Terms and the Privacy Policy constitute the entire agreement between you and Lulai regarding use of the App.

18. Changes

We may update these Terms. The current text will be posted on our website and/or in the App. Continued use means you accept the new Terms.
